This privacy notice for ZodTTD LLC ("ZodTTD," "we," "us," or "our") explains how we collect, use, disclose, and retain information when you use the paid Psimulator application and related services, including Psimulator Support, community submissions, the Download Center, Psimulator Sync, RetroAchievements, and related backend services (collectively, the "Services").
Sections 1 through 13 are Psimulator's Privacy Policy. Sections 14 through 22 are Psimulator's Terms of Service and end-user license terms. Please read both parts. If you have questions, wish to make a privacy request, or need to report content, contact psimulator@zodttd.com.

1. WHAT INFORMATION DO WE COLLECT?
Information you provide
- Support information: When you contact Psimulator Support in the app, we may receive a category, subject, message, and information you choose to include. A support or bug report may also include individual app and game diagnostics that you explicitly enable, such as the Psimulator version, game name or identifier, file type, and whether a BIOS is present. Psimulator does not intentionally attach your BIOS or game file to a support request. A private in-app credential lets you continue the conversation without providing a name, email address, or account.
- Content reports: When you report community or Download Center content, we may receive the reported item's identifier and type, the reason you select, an optional explanation, app version and locale, and pseudonymous or cryptographically transformed installation and network information used to prevent duplicate or abusive reports. A content report does not automatically attach or upload the reported game, save, VMU, or controller-skin file from your device.
- Community content: If you submit content for community review, we may receive a public creator handle, title, description, metadata, preview images, controller-skin files and visual assets, VMUs, save states, and other material you choose to submit. Approved content and its public attribution may be published in the Download Center. A private in-app credential lets you review the submission and contact an administrator without providing a name, email address, or account.
- Communications: We receive the information in messages and privacy requests you send to us.
Information collected when you use Psimulator
- App and device information: Psimulator version, bundle information, device type, operating-system information, locale, and system language when required by a feature you use or included in a support request.
- Approximate country or region: A service may derive an approximate region from an Internet Protocol (IP) address to localize content, enforce rate limits, prevent abuse, and protect the Services. Psimulator Support may use short-lived or cryptographically transformed network information for those purposes.
- Diagnostics: Technical events, request status, error information, response timing, and other diagnostic data used to operate, secure, and troubleshoot the Services.
Files stored locally or used with optional features
Games, BIOS files, VMUs, save states, controller skins, and related emulator data normally remain on your device. We do not receive those files merely because you play a game. They leave your device only when you intentionally use a feature that transmits them, such as a community submission, a support attachment where offered, or Psimulator Sync. The first-party boot request does not upload your games, BIOS files, VMUs, save states, controller skins, name, email address, or other unrelated local files.
Information from other sources
We may receive distribution information from Apple and status or metadata from cloud-storage providers you connect. We may also receive information required to investigate fraud, abuse, legal claims, or security incidents.
Sensitive information: We do not intentionally request sensitive personal information. Please do not include sensitive information in support messages, descriptions, metadata, or community submissions.
2. HOW DO WE USE YOUR INFORMATION?
We use information to:
- provide, maintain, localize, synchronize, and improve Psimulator and related Services;
- respond to support requests and diagnose technical problems;
- receive, review, moderate, approve, reject, publish, translate, and maintain community content;
- provide localized Support content and apply app-version and frequency rules to eligible Support content;
- operate the retained startup handshake and troubleshoot service performance;
- enforce rate limits, protect users and the Services, prevent fraud or abuse, and investigate security incidents;
- comply with law, respond to valid legal requests, and establish or defend legal claims; and
- carry out another purpose disclosed when information is collected, with your consent where required.
3. APP PRIVACY PRACTICES
Psimulator is a paid app. It does not display advertising, use third-party advertising or analytics SDKs, or track your activity across other companies' apps or websites.
Psimulator performs one first-party HTTPS boot request to zodttd.com after installation. The request contains only a fixed API action and protocol version. A successful result is recorded locally so later launches do not repeat the request. The request is used only to complete first-run service initialization and is not used to profile users or measure product interaction.
4. PSIMULATOR SYNC AND THIRD-PARTY CLOUD SERVICES
Psimulator Sync is optional. If you connect Google Drive or Dropbox, Psimulator uses the provider's interfaces to store and retrieve the emulator data you select for synchronization in your cloud account. This may include games and related files, BIOS files, VMUs, save states, controller skins, metadata, identifiers, hashes, file sizes, and modification information needed to synchronize or delete items safely.
When you choose Google Drive Sync, Psimulator uses Google Sign-In to authenticate your Google account. Google may process account, device, usage, and diagnostic information for authentication, app functionality, security, and its own service operations. Psimulator uses the sign-in result only to provide the Google Drive Sync feature. Google processes this information under its own privacy policy.
Your cloud provider processes this data under its own terms and privacy policy. You can stop synchronization, disconnect a provider, or use Psimulator's synced-data controls to delete supported remote items. Copies, provider backups, conflict versions, or deleted items may remain for the period described by the provider. See the Google Privacy Policy and Dropbox Privacy Policy.
5. WHEN AND WITH WHOM DO WE DISCLOSE INFORMATION?
We may disclose information in these circumstances:
- Service providers: To hosting, storage, security, email, support, and infrastructure providers that process information for us.
- Apple: For paid App Store distribution and platform services. See Apple's Privacy Policy.
- Cloud providers: To Google or Dropbox when you connect the corresponding Psimulator Sync service.
- The public and community users: When you submit content for publication, approved files, previews, titles, descriptions, creator attribution, supported-device information, and other approved metadata may become public. Public copies may be downloaded and retained by others.
- Legal and safety reasons: When we reasonably believe disclosure is necessary to comply with law or valid legal process, protect rights or safety, investigate abuse, enforce applicable terms, or defend legal claims.
- Business transfers: In connection with a merger, financing, reorganization, sale of assets, acquisition, or similar transaction, subject to applicable law.
- With your direction or consent: When you ask us to disclose information or consent to another disclosed use.
We require third parties that process user information for us to protect it consistently with this notice, our contractual requirements, and applicable law. Independent services such as Apple, connected cloud providers, and RetroAchievements also process information under their own published terms and privacy notices.
We do not sell personal information for money, share it for cross-context behavioral advertising, or use it for targeted advertising.
6. LEGAL BASES FOR PROCESSING
Where a legal basis is required, we process information as necessary to perform a contract with you, provide features you request, comply with legal obligations, protect vital interests, pursue legitimate interests that are not overridden by your rights, and obtain consent where required. Legitimate interests may include operating and securing the Services, responding to support requests, moderating community content, measuring our Services, preventing fraud, and improving Psimulator. You may withdraw consent at any time, but withdrawal does not affect earlier lawful processing.
7. HOW LONG DO WE KEEP INFORMATION?
We retain information only for as long as reasonably necessary for the purposes in this notice, including providing Services, resolving support matters, publishing community content, protecting the Services, meeting legal obligations, and handling disputes.
- Support requests and content reports: Retained while needed to respond, maintain support and moderation history, diagnose recurring issues, protect the Services, resolve disputes, and meet legal obligations.
- Community submissions: Pending submissions are retained while awaiting review. Rejected quarantine files are normally eligible for deletion after 90 days. Approved source files are removed from quarantine only after a durable published or retracted copy has been verified. Published or retracted records and files may be retained while needed to operate the community catalog, document moderation decisions, respond to disputes, or comply with law.
- Service requests: Operational logs and temporary rate-limit records are retained only as long as reasonably needed for reliability, security, abuse prevention, or legal compliance.
- Psimulator Sync: Synced files remain in your connected cloud account until deleted through Psimulator or the provider, subject to the provider's backup and deletion practices.
Configuration, legal requirements, active investigations, backup cycles, or a valid preservation obligation may require a different period. When information is no longer required, we delete it, de-identify it, or securely isolate it until deletion is possible. Removing public community content cannot ensure deletion of copies previously downloaded by other users.
8. HOW DO WE KEEP INFORMATION SAFE?
We use reasonable administrative, technical, and organizational safeguards designed to protect information, including access controls, encrypted network transport where supported, data minimization, validation, rate limiting, and separation of quarantined community files from published content. No transmission or storage method is completely secure, so we cannot guarantee absolute security.
9. YOUR PRIVACY CHOICES AND RIGHTS
- Psimulator Sync: You may disconnect a connected provider and use Psimulator or your provider's controls to manage remote data.
- Community submissions: Submission is optional. Do not submit content you do not want reviewed, stored, and, if approved, published.
- Hidden community creators: Psimulator lets you hide or unhide community content by creator. This preference is stored on your device and is not submitted as a content report.
- Privacy requests: Depending on where you live, you may request access, correction, deletion, portability, restriction, or objection, and may appeal a denied request. You may also withdraw consent where applicable.
To make a request, email psimulator@zodttd.com. Please describe the Service and data involved and provide enough information for us to locate the relevant records. We may need to verify your request. We will not discriminate against you for exercising applicable privacy rights. We may deny or limit a request where permitted by law, including when we cannot verify it, must preserve another person's rights, or must retain records for legal, security, transaction, or fraud-prevention purposes.
10. CHILDREN'S PRIVACY
We do not knowingly solicit personal information from or market to children under 18. A parent or legal guardian who believes a minor provided personal information may contact us to request review or deletion. If we learn that we collected personal information from a child in a manner prohibited by applicable law, we will take appropriate steps to delete it.
11. INTERNATIONAL DATA TRANSFERS
ZodTTD and its service providers may process information in the United States and other countries where privacy laws may differ from those where you live. Where required, we use appropriate safeguards for international transfers. Third-party providers process information in the locations described in their own privacy notices.
12. UPDATES TO THIS NOTICE
We may update this notice as Psimulator, our providers, or legal requirements change. The revised notice will show a new "Last updated" date and becomes effective when posted unless another date is stated. We may provide additional notice in Psimulator when a change is material or when law requires it.

14. ACCEPTANCE AND APP LICENSE
By downloading, installing, accessing, or using Psimulator or the Services, you agree to these Terms of Service. If you do not agree, do not use Psimulator or the Services. If you are not legally able to enter into these Terms on your own, you may use the Services only with the permission and supervision of a parent or legal guardian who agrees to these Terms.
Psimulator is licensed, not sold. The Apple Licensed Application End User License Agreement ("Apple Standard EULA") applies to the Psimulator app and is incorporated here by reference. These Terms supplement the Apple Standard EULA and govern Psimulator's related Services, community features, and content. If these Terms conflict with the Apple Standard EULA concerning the app license, the Apple Standard EULA controls.
Subject to these Terms and the Apple Standard EULA, ZodTTD grants you a limited, personal, non-exclusive, non-transferable, revocable license to use Psimulator on Apple-branded devices you own or control as permitted by Apple's Usage Rules. ZodTTD and its licensors retain all rights not expressly granted. Open-source components remain governed by their respective licenses, which are listed in Psimulator's Software Licensing Information.
15. LAWFUL USE OF GAMES, BIOS, AND OTHER CONTENT
Psimulator is a Dreamcast emulator and does not include commercial Dreamcast games or proprietary Dreamcast BIOS files. You are responsible for obtaining, copying, importing, using, and sharing games, BIOS files, artwork, save data, controller skins, and other content only when you have the legal right to do so. Psimulator must not be used to infringe copyright, bypass access controls unlawfully, or obtain or distribute unauthorized content.
Content offered through the Download Center is made available only after review, but availability through Psimulator is not a representation that every use of that content is permitted in every jurisdiction. You remain responsible for complying with applicable law and any license displayed with an item.
16. COMMUNITY CONTENT AND SUBMISSIONS
You retain any ownership rights you have in content you submit. By submitting content for review or publication, you represent that the submission is accurate, is not misleading, and that you own it or have all rights and permissions needed to submit it and authorize its storage, review, reproduction, formatting, translation, display, distribution, and publication through the Services.
You grant ZodTTD a worldwide, non-exclusive, royalty-free license to host, copy, validate, format, translate, create technical previews of, display, distribute, publish, maintain, and make the submitted content available through Psimulator and related Services. This license lasts for as long as reasonably needed to operate the community catalog, honor prior downloads, document moderation decisions, resolve disputes, and meet legal obligations. Submission-specific terms shown in Psimulator when you submit content also apply.
Creator handles, titles, descriptions, previews, supported-device information, and other approved metadata may be public. Do not submit a legal name or other personal, confidential, or sensitive information as a creator handle or within submitted content. Public copies may remain with users who downloaded them before later removal.
17. PROHIBITED CONDUCT AND CONTENT
You may not use Psimulator or the Services to:
- submit, download, distribute, or facilitate content that is unlawful, infringing, fraudulent, deceptive, threatening, hateful, harassing, sexually exploitative, grossly offensive, or otherwise objectionable;
- submit malware, corrupted files, hidden executable behavior, or material intended to damage, disrupt, monitor, or gain unauthorized access to a device, account, network, or Service;
- impersonate another person, misrepresent ownership or authorization, expose another person's private information, or interfere with another person's use of the Services;
- evade moderation, rate limits, security measures, geographic or age restrictions, or a suspension or removal decision;
- scrape, overload, reverse engineer, probe, or attack the Services except where applicable law expressly permits the activity; or
- use Psimulator or the Services in violation of applicable law, third-party rights, an item's license, or these Terms.
18. MODERATION, REPORTING, AND ENFORCEMENT
ZodTTD may review, reject, restrict, unpublish, remove, or preserve community content, and may limit or terminate access to submission or community features, when we reasonably believe content or conduct violates these Terms, applicable law, third-party rights, or the safety and integrity of the Services. We are not obligated to publish a submission or keep published content available.
To report offensive, age-inappropriate, unsafe, or infringing content, use the flag control provided with the item in Psimulator, or email psimulator@zodttd.com. Identify the item and explain the reason for the report. We may request additional information, disclose a report where reasonably necessary to investigate it or comply with law, and take action we consider appropriate. Knowingly false or abusive reports may themselves violate these Terms. The same flag control can hide or unhide content by a community creator on your device.
19. PAID APP AND EXTERNAL SERVICES
Psimulator is sold as a paid App Store app. It has no in-app purchases or subscriptions; all included features are available with the app purchase.
Psimulator may link to or interoperate with services such as Apple, Google Drive, Dropbox, YouTube, RetroAchievements, and community content providers. Those services may have separate terms and privacy policies. ZodTTD does not control and is not responsible for third-party services, content, availability, or conduct, except to the extent applicable law provides otherwise.
20. AVAILABILITY, TERMINATION, AND CHANGES
Services and content may change, be interrupted, become unavailable, or be discontinued. We may add or remove features and may update these Terms by posting a revised version with a new "Last updated" date. When required by law, we will provide additional notice or request consent. Continued use after an effective update means you accept the revised Terms to the extent permitted by law.
You may stop using Psimulator at any time. Rights granted under these Terms end automatically if you materially violate them. Provisions that by their nature should survive termination—including ownership, licenses needed for previously published submissions, disclaimers, limitations of liability, dispute-related terms, and legal-compliance obligations—will survive.
21. DISCLAIMERS AND LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Psimulator, the Services, and community content are provided "as is" and "as available," without warranties of any kind. ZodTTD does not guarantee that Psimulator will be uninterrupted, error-free, secure, compatible with every game or file, or that community content will be accurate, lawful, safe, or continuously available.
To the maximum extent permitted by applicable law, ZodTTD and its affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, saves, content, profits, revenue, goodwill, or service availability, arising from or related to Psimulator or the Services. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or any mandatory consumer rights available where you live. The warranty and liability provisions of the Apple Standard EULA also apply to the app license.
22. GENERAL TERMS AND CONTACT
If a provision of these Terms is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms or your rights under them except as permitted by the Apple Standard EULA; ZodTTD may transfer them as part of a merger, acquisition, reorganization, or sale of assets, subject to applicable law. Mandatory consumer protections and dispute rights in your country or region remain unaffected.
These Terms, the Privacy Policy, the Apple Standard EULA, any submission-specific terms you accept, and any terms presented for a particular feature form the agreement governing your use of Psimulator and the Services.
